In this article, we will take a look at how the Usercentrics CMP can be built into your website in order to be compliant with the Brazilian Data Protection Law (LGPD).
The LGPD and the European Data Protection Law GDPR have several similarities but also some differences. In order to be privacy compliant, we have to take those into account.
- Since LGPD is a Brazilian Legislation, ensure Brazilian Portuguese is added to your configuration as an editable and visible language.
To do this, select Configuration, use the + Add Language button on the Setup tab, select Portuguese (Brazil), and click the Add Languages button. - Select the Legal Specifications tab and ensure “Display CMP to all users (default)” is selected under Regional Settings.
- Ensure that both California Consumer Privacy Act (CCPA) and Transparency & Consent Framework (TCF) are not enabled.
- In order to be fully LGPD compliant, please have a look at the Data Processing Services.
Navigate to Service Settings and select the Data Processing Services tab. - Add any Data Processing Service that are in use on your website.
In this example, we will select “Google Analytics 4”. - Open the service to adjust the legal basis, enable Custom Legal Basis, and enter “LGPD” in the search bar. Here you will find the different legal bases defined by the LGPD.
Select the legal basis that fits your needs for each of your Data Processing Services. - Finally, please check that all the information in our predefined templates is consistent with your data processing services and use our "Custom Templates" if necessary.
Here you can enter all the information adapted to your needs.
Congratulations! With this setup, you are good to go for your operations in Brazil.
